Please read these Terms of Service ("Terms") carefully before downloading or using any Vexifa software application (the "Software") or visiting vexifa.com (the "Website"), operated by Vexifa ("us", "we", or "our").
By downloading or using the Software, you agree to be bound by these Terms. If you do not agree, do not use the Software.
1. Products and Licensing
Vexifa provides native Windows desktop applications. The following licensing models apply:
1.1 Free Applications
Vexifa Cyber Secure, Vexifa SmartSleep, Vexifa PDF Auditor, and Vexifa PDF Suite are provided free of charge. By downloading them you receive a non-exclusive, non-transferable license to install and use the software on Windows devices you own or control, for personal and commercial purposes. Every feature is included in the free download — there are no paid tiers, no degraded modes, and no feature gates.
1.2 Optional Support Subscriptions
Vexifa PDF Suite offers an optional annual subscription via PayPal at $19/year. You subscribe on a PayPal page and activate it in-app from Settings → License by pasting your PayPal subscription or transaction ID. Subscribing removes a brief launch reminder shown after a 60-day grace period and helps fund continued development. Subscribing does not unlock any additional features — the underlying application is fully functional with or without a subscription.
- Subscription renewal: Subscriptions renew automatically unless cancelled before the renewal date from your PayPal account.
- Cancellation: You may cancel at any time from your PayPal account. Cancelling stops future billing. The subscription benefit (no launch reminder) remains through the end of the current paid period. After expiry, the application continues to work with every feature available — only the post-grace-period launch reminder returns.
- Refunds: Vexifa is the merchant of record for this subscription and handles refund requests directly (via PayPal) under its refund policy. See our Refund Policy for details.
- Subscription check: The subscription or transaction ID you paste is stored locally on your device and treated as active for one year from activation. The check is performed entirely on your device — the ID is not transmitted to Vexifa, and no separate license key is required.
1.3 Beta and Coming Soon Products
Products marked "Coming Soon" are in pre-release development. Submitting your email for launch notification does not constitute a purchase or binding commitment by either party.
2. Local-First Architecture and Your Data
All Vexifa desktop applications are built on a local-first architecture. Your files, project data, email lists, scan results, and creative assets are stored on your machine, not on Vexifa servers. This is an architectural characteristic, not merely a policy commitment.
- We do not have access to data you create or process within any Vexifa application.
- Uninstalling the Software or deleting the application's data folder permanently removes all locally stored data. Vexifa cannot recover this data on your behalf.
- You are solely responsible for backing up your local data.
3. Third-Party Integrations
Certain applications allow integration with third-party services (AWS SES, Mailgun, OpenAI, Anthropic, OpenRouter, Ollama, and others) using API keys you provide. When you use these integrations, your data is transmitted directly from your machine to the third-party provider — it does not pass through Vexifa servers.
- You are solely responsible for complying with the terms of service and acceptable use policies of any third-party service you connect.
- You are solely responsible for any costs, overages, or account actions resulting from your use of third-party APIs through Vexifa software.
- Vexifa is not liable for service interruptions, billing discrepancies, or policy violations at third-party providers.
4. Acceptable Use
You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code of any Vexifa application.
- Use any Vexifa application to violate applicable laws, regulations, or third-party rights.
- Use Vexifa EMP or any sending tool to transmit unsolicited commercial email (spam) or to violate CAN-SPAM, CASL, GDPR, or other applicable anti-spam laws.
- Circumvent or attempt to circumvent license validation mechanisms.
- Resell, sublicense, or transfer your license to any other party without written consent from Vexifa.
5. Healthcare and Legal Compliance Modes
Vexifa PDF Suite includes Healthcare and Legal compliance Modes as runtime settings selectable in Settings → Mode. These Modes are part of the standard free download — they are not separate paid editions. Users who select Healthcare or Legal Mode are subject to additional behaviors and constraints specific to those Modes, including Business Associate Agreement (BAA) architecture for Healthcare Mode users and privilege-aware AI guardrails for Legal Mode users.
Vexifa does not process, access, or store Protected Health Information (PHI) or privileged legal documents. The Healthcare and Legal Modes provide compliance-supportive controls; ultimate compliance responsibility remains with the licensed user and their organization. Enterprise customers can deploy a policy file at C:\ProgramData\Vexifa\policy.json to lock the application into a specific Mode and disable individual features for managed devices.
6. Intellectual Property
The Software and all associated intellectual property rights are owned by Vexifa. These Terms grant you a license to use the Software; they do not transfer ownership. All rights not expressly granted are reserved.
7. Disclaimer of Warranties
The Software is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. Vexifa does not warrant that the Software will be error-free, uninterrupted, or that it will meet your specific requirements.
Vexifa does not guarantee any particular outcome from use of the Software, including but not limited to search engine rankings, email deliverability rates, security scan completeness, or document compliance certification.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Vexifa shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or business interruption, arising from your use of the Software, even if Vexifa has been advised of the possibility of such damages.
Vexifa's total liability for any claim arising from these Terms or your use of the Software shall not exceed the amount you paid for the Software in the twelve months preceding the claim.
9. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on vexifa.com with a revised "last updated" date. Continued use of the Software after changes are posted constitutes your acceptance of the revised Terms.
10. Governing Law
These Terms are governed by the laws of the United States, without regard to conflict of law provisions.
